Your legal rights
Your purchase of Goods and Service will be subject to certain laws including, without limitation, the Australian Consumer Law. The Australian Consumer Law provides you with certain rights that cannot be excluded, including that the Goods and Service must be of acceptable quality, reasonably fit for the purpose that Honey Baby Collection (HBC) represents they will be fit for, and that the Goods and Service will correspond with any relevant description. Nothing in these Terms and Conditions shall be read or applied so as to exclude, restrict or modify or have the effect of excluding, restricting or modifying any condition, warranty, guarantee, right or remedy implied by law (including the Australian Consumer Law) which cannot by law be excluded, restricted or modified.
Pricing & Taxes
All prices listed on Honey Baby Collection (HBC) are in Australian dollars and include the Goods and Services Tax (GST).
HBC reserves the right to change the prices of Goods and Service at any time without notice to you. The price displayed at the time that you place your Order will continue to apply to you even if the price changes before your Order is accepted by HBC.
The price for the Goods and Service on HBC are not subject to delivery and fee charges. You will also need to pay the listed delivery charge at checkout. Any Delivery Charge will appear in your shopping cart before transaction finalised.
By placing an Order, you agree to pay the price for the Goods and Services and any Delivery fees.
If shipping to overseas address, addition import and tax fees may apply.
An Order submitted by you is an offer by you to purchase the Goods and Service for the price plus the Delivery Charge as shown at the time of submission of your Order. HBC may accept or reject your offer in its absolute discretion. In particular, but without limitation, HBC may reject Orders depending on stock availabilities.
By proceeding with your order, you acknowledge that all Goods that you Order are intended for personal, domestic, non-commercial use only.
Please ensure that you enter all information carefully when placing an Order. You warrant to HBC that all information provided by you in relation to each Order is complete, true and accurate. Information will include but not limited to name, address, email, contact number and payment details.
Except to the extent otherwise required by law (including, without limitation, the Australian Consumer Law), HBC will not be liable to you, or any other person, for any loss, damage, cost or expense suffered as a direct or indirect result of your Order information being incomplete, inaccurate or as a result of being unable to change or cancel your order once it has been accepted by HBC, whether in contract, negligence or any other tort, equity, restitution, strict liability, under statute or otherwise at all.
If you place an order for another individual to receive, you must obtain their consent before provide HBC with their personal information and, by placing the order you are confirming with HBC that you have done so.
Your HBC product(s) will be dispatched after Order is placed and payment is cleared.
You must take your own precautions to ensure that by accessing the website you are not exposed to risk of viruses, malicious computer codes or other forms that may damage your computer system. You must have your own appropriate protection to prevent damages to your computer system caused by viruses, malicious computer code or other forms of risks.
HBC will process payments for your Order when you place your Order. Your Order is deemed to be accepted by HBC when HBC does this, however HBC may, in certain circumstances, cancel your Oder after acceptance as set out in these Terms & Conditions. In the event that HBC cancels your Order having already processed payment, it will refund your payment back to your purchased method.
You may process your payments for Goods and Services using the following payment methods: credit card, (Visa, MasterCard or American Express) and Paypal.
You must not pay, or attempt to pay, for Goods through any fraudulent or unlawful means. If the name on the payment card/ account does not match the name on the Order, HBC may refuse to accept the Order or ask you to provide additional information in accordance with its fraud detection processes. By providing your payment card you authorise HBC to deduct the price and the applicable delivery charge(s) from such cards.
HBC reserves the right to change the payment methods that can be used for Order at any time in its absolute discretion.
Goods and Services that you have ordered will not be dispatched to you until we receive payment for your items and they have been accepted by HBC. If your payment cannot be process, your Order will be rejected and HBC will notify you.
Cancellation of Orders:
HBC reserves the right to cancel order at anytime before delivery and for whatever reason, even if the Order has previously been accepted.
You may cancel your Order where HBC:
a) Is not able to deliver your Order according to the estimated delivery time listed on the Website for the applicable selected Delivery Option, other than a result of any delay (i) for which you are partly responsible such as a failure to provide the correct delivery address or to pay for the Good; or (ii) which was outside HBC control.
Where HBC cancels your order after acceptance it will send you an email notifying you of cancellation.
When you order a product to be delivered, you will be required to select one of the available Delivery Options for you order. HBC will do our best to deliver the goods in your Order by the estimated delivery time for the Selected Delivery Option.
When you purchase delivery for your Goods, you agree to comply with the delivery requirement specified.
- Delivery will be made to the nominated address. The order will not be delivered to any location other than the address on the order confirmation.
- The person accepting delivery of the order must print their name and sign the delivery manifest with the time and date of delivery.
Delay in availability or Delivery of Goods
HBC does not guarantee the dispatch or delivery or availability of Goods within estimated delivery time listed.
Stock availability and events outside HBC's control may cause delays, or in some circumstances, prevent your Goods from being delivered.
Delays are most likely to occur during busy seasons and sale periods. Such as Christmas, Easter or public holidays.
Where HBC is obligated to refund your payments according to these Terms and Conditions, HBC aims to initiate your refund as soon as possible (Monday-Friday 9 am to 5 pm Melbourne time).
If your order has been purchased using a gift card, you will be refunded and process as a new eGift.
HBC will not be liable to you, or any other person, for any loss, damage, cost ft expense suffered as a direct or indirect result of any delay in you receiving any refund due to you, whether in contact, negligence or any other tort.
Please ensure you check your Goods as soon as they are delivered to you in order to ensure that:
- They are the product you ordered
- They are not damaged or faulty. If your product is damaged ot faulty please contact HBC as soon as possible.
When returning Goods:
- Please provide HBC with your proof of purchase
- You may not be entitled to any refunds or exchange if any packaging is damaged in transit. The packaging purpose is to protect the Goods themselves.
